User Agreement

This User Agreement governs the relationship regarding the Internet resource https://midea.kz/ (hereinafter referred to as the “Website”) between the Website Owner and the User under the following terms:

The text and content of the User Agreement may be changed by the Owner at any time without any special notice to the User. The new edition of the User Agreement shall come into force from the moment it is posted by the Owner on the Website at: https://midea.kz/term-of-use/, unless otherwise expressly stated by the Owner in a separate accompanying message. It is the User’s responsibility to regularly review the current version of the User Agreement. The use of the Website by the User after the entry into force of a new edition of the User Agreement signifies the User’s full consent and the application of the provisions of the User Agreement in the new current edition to the relationship between the User and the Owner.

1. Terms and Definitions

1.1. User — a visitor to Internet resources, including the Website.

1.2. Website — the Internet resource located at: https://midea.kz/.

1.3. Website Owner — “IMBT” LLP.

2. General Provisions

2.1. The Owner offers the User the opportunity to use the information, resources, and services of the Website under the terms of this User Agreement.

2.2. The information, resources, and services of the Website are provided to the User free of charge, unless otherwise stated on the Website.

2.3. The provision of specific information, resources, and services of the Website may be governed by special rules and/or agreements, which are an integral part of this User Agreement and are provided on the Website.

2.4. Regardless of the fact of registration or authorization on the Website, the User’s use of the Website, including viewing information posted on the Website, signifies the User’s full consent to this User Agreement and the assumption of obligations to follow the instructions for using the Website, as well as the liability provided for the User.

2.5. By accessing the Website and entering into this User Agreement, the User guarantees that they possess all the rights and powers necessary to conclude and execute the User Agreement in accordance with the current legislation of the Republic of Kazakhstan.

3. Information Provided by Users

3.1. Within the framework of using the Website, the User undertakes to provide only reliable information and independently bears full responsibility for such provided information. The User undertakes to update this information in a timely manner.

3.2. In the process of using the Website, the User independently and voluntarily:

3.2.1. decides to provide the Owner with or post in the public domain their personal and other information, taking into account the Privacy and Personal Data Processing Policy, the current text of which is located at: https://midea.kz/ (hereinafter referred to as the “Policy”);

3.2.2. declares their consent to the processing of personal and other User data by the Website, including for the purposes of: providing advisory support to Users in connection with the use of the Website; delivery of messages to other Users; obtaining statistical and analytical data to improve the functioning of the Website; receiving information and/or advertising messages from the Website, including in the form of short messages (SMS) to mobile phone numbers and e-mails to the e-mail addresses specified by the User or their representative, or posted using the Website, or in the form of notifications via the Website, as well as in the form of interactive graphs, detailed reports, and other analytical reports; preventing or suppressing illegal and/or unauthorized actions of Users; ensuring compliance with the requirements of the current legislation of the Republic of Kazakhstan.

3.3. The Website Owner takes all necessary measures to protect the User’s personal data from unauthorized access by third parties in accordance with the Policy.

3.4. The Website Owner does not provide the User with consultations on issues not related to the Website.

3.5. The User agrees:

3.5.1. to the collection of anonymized statistical data about the User by the Website;

3.5.2. to the transfer of anonymized statistical data by the Website Owner to third parties, including for the purposes of their processing, to ensure the functioning of the Website, the implementation of partner and other programs of the Website, provided that the Website Owner complies with the conditions reflected in the Policy.

4. Obligations of the User

4.1. The User undertakes to act exclusively in accordance with the current legislation and this User Agreement, as well as to bear full responsibility for their own actions and omissions on the Website in accordance with the legislation of the Republic of Kazakhstan.

4.2. The Website may be used by the User exclusively for the purposes for which this Website is intended.

4.3. The User also undertakes not to copy, reproduce, modify, distribute, or present to the public any information contained on the Website (except for information provided by the User themselves) without the prior written permission of the Website Owner and any third party (if the information also affects the interests of these third parties).

4.4. In order to suppress or prevent a violation of the User Agreement and/or cause damage to the Website (for example, DDoS attacks or other hacker attacks, unauthorized use of software, etc.), the Owner has the right to restrict Users’ access to the Website by blocking access from the corresponding IP address or range of IP addresses.

4.5. By accessing the Website, the User expresses their consent to receive advertising information posted on the Website by third parties. The User understands and agrees that the Website does not determine the content and is not responsible for such information, including websites to which links may be contained in relevant materials.

5. Warranties and Liability

5.1. The User is liable for actions performed on the Website in accordance with the current legislation of the Republic of Kazakhstan.

5.2. The Website and the Website Owner are not responsible for the loss of information by the User, as well as for the distortion of information or the loss of a message received using the communication forms on the Website.

5.3. The Website and the Website Owner are not responsible for non-performance or difficulties in the performance of obligations due to the action of force majeure circumstances, the consequences of which cannot be avoided or overcome.

6. Term of the User Agreement

6.1. This User Agreement comes into force from the moment the User begins to use the Website, regardless of the fact of User registration, and is valid indefinitely.

6.2. The User has the right to terminate access to their Personal Account without the possibility of restoring such access.

6.3. The Website Owner reserves the right, at its sole discretion, to terminate the access of a User who violates this User Agreement or other rules regulating the functioning of the Website, including terminating or temporarily suspending the User’s access to the Personal Account. The User does not have the right to use the credentials of another User to access the Website.

7. Disputes and Applicable Law

7.1. The current legislation of the Republic of Kazakhstan shall be applied in resolving all disputes under this User Agreement.

7.2. Due to the gratuitous nature of the use of the Website, the provisions of the legislation on the protection of consumer rights are not applicable to the relationship between the User and the Website Owner.

7.3. All disputes arising within the framework of this Agreement shall be resolved by the Parties through negotiations. In case of impossibility to settle the dispute through negotiations, disputes shall be resolved in court in the manner prescribed by the current legislation of the Republic of Kazakhstan, at the place of establishment of the Website Owner.

7.4. Recognition of individual parts of this User Agreement as invalid does not cancel the validity of other provisions of this User Agreement.
